Doctors Group Sues HHS Over Patient Privacy Regulations A group of doctors in South Carolina has filed a federal lawsuit challenging the authority of HHS to develop and implement restrictions on the use of patients’ medical records. The South Carolina Medical Association claims that Congress violated the Constitution when it delegated its lawmaking authority to an agency of the executive branch. Furthermore, the group claims that even if the delegation of lawmaking authority was constitutional, HHS went beyond the law’s intent by developing 1,500 pages of regulations that will drastically and often needlessly change the ways doctors practice medicine.
