The Tax Court has held that the charitable deduction for a charitable remainder annuity trust (CRAT) must be denied because the trust failed to pay the required annual distributions of 5% to the noncharitable beneficiary and a settlement between the trust and one of its beneficiaries left the charitable remainder unprotected against invasions of corpus for noncharitable purposes.
