How To Use QDRO's After Divorce To Collect Child Support and Alimony
USING QDRO's TO COLLECT PAST DUE SUPPORT AND ALIMONY If your divorce has been completed and your former spouse is not paying child support and/or alimony that has been ordered by the Court, you may have another collection tool: If your ex is covered by a qualfied retirement plan such as a 401(k), a Qualified Domestic Relations Order (QDRO) may be available to you. That's right! Even though you may have received a share of your former spouse's retirement as part of your property settlement at the time of divorce, a second QDRO, you may have the option of going back to court to get a second QDRO which will pay both delinquent and prospective payments of alimony or child support. Be sure to check with you lawyer.
